Nobody REALLY knows wether sony is going to start to ban users with 3.55 cfw or not. 3.41 on the other hand can't really be banned, because it's not taken online at any point. If sony decides to start banning consoles running 3.55 cfw, it will most likely last forever, unless they're feeling genorous. If George Hotz wins his case, most likely jailbreaking will become legal, just like jailbreaking the iphone/itouch became.
