He'll win. I'm not seeing why we should pay 300$ for something and not be able to do whatever the heck we want with it. I mean, it's fieces enough that they won't let him release his own firmwire, now they expect us not to continue his work. Hotz will win the case as I know people who work for a local Sony DADC in my area who work with hardware all the time who support having free rights to do whatever the heck you want for your devices paying as much as we do now a days for them. Hotz poses way more sense in this case.
