I think that sony is right now when u update getting info from ur system about stuff you have done, like run and stuff. I think sony is saving this for future bans.

Ive also heard that each time you log onto PSN sony will be given a log of what have been done on PS3 so I think they are allowed to.

If it says that they are allowed to in their terms and conditions then they are, but for now unsure.

there probably something about they have rights to view information on your account in the agreement.

Backing up games isn't that big a deal, i mean, most of the people on the CFW have went on it for call of duty challenge lobbies, there has been so many game sales and ps3 sales that sony shouldn't really be banning people for backing up games.
Sony have lots of other electrical appliances such as TV's & Camcorders that they shouldnt be worrying or getting all frustrated and angry over people backing up games.
It is like what was said about the iPod/iPhone getting jailbroke. It is like monopoly, you buy something worth a lot of money and they expect you to pay more money to get things for it.
