Sony is pushing out more legal actions against all major PS3
hackers/devs including: Cantero, Peter, Bushing, Segher, hermesEOL, kmeaw, Waninkoko, grafchokolo and kakaroto. Sony is planning to subpoena (definition) various internet sites such as; PSX-SCENE, YouTube, Twitter, PayPal and Slashdot inorder to find the hackers.You can grab and see the legal documents below.

NOt only is Geohot screwed but they are also coming for everyone of the other CFW hackers out there. I think this may be the reason behind why some of you arent getting your cfw any time soon. I have a ps3 80 gb fat with geohots JB as first install then i went back to OFW and installed Kmeaw. So for all you people out there looking for your 3.56 Cfw...i hate to say it but its gonna be some time before anyone gets the CFW. Just wanted to clear some things up and stop everyone of those noobs posting CFW 3.56 RELEASED! no....get a life and stop trying to get rep for nothing. SONY IS LOOKING FOR YOU! (jk they really arent)

Things are seeming to go from bad to worse in Sony’s image. Just a few hours ago the well known DNS bypass trick has been blocked forcing you to update if you wish to play on PSN (an all other tools/methods). We must wait for the 3.56 CFW if we want to play on PSN again (or update to OFW 3.56).

In further news the Sony vs Geohot case is starting to pickup heat as Sony is now gathering evidence. Sony has demanded that Youtube give up information of Geohot’s youtube account where THIS jailbreak video was originally revealed AND, how many users had accessed the video, the usernames and IP addresses of everyone who viewed/posted/published comments related to the video…meaning this information probably includes YOU. A bit of an overkill don’t you think?

Furthermore, Sony has demanded Twitter to give information related to everyone on the Fail0verflow Team (good luck with that), and take them down as well.

it is my good faith belief that none of the code at hermesEOL/fail0verflow (see reference below) infringes on Sony’s copyrights, and that their takedown notice is in error. further, Sony is attempting to abuse the DMCA to avoid public embarrassment (too late) and put the genie back in the bottle (too late), and has failed to meet the minimum requirements for giving DMCA notice (no details provided on which source code lines infringe copyright). the exposure of sloppy crypto implementation on Sony’s part in no way infringes on copyright or makes available any of their proprietary internal software; the repository in question contains exclusively original third-party code that does not directly facilitate infringement.

please restore public access to the source repository in question. this shall serve as my electronic signature.

As you can see in above text it seems that some people are of the opinion that of sony is failing to meet requirements of DMCA laws,I just wonder if there is any truth is what this guy is saying?. only time will tell, This may mean sony have no chance in hell of winning their legal battle as its there own code that has put them in the postion they are in now .

Sony May Finally Get What They Deserve!

Sony with a little legal trouble of their own… As the title suggests, LG Electronics in Seoul of South Korea are making claims against Sony — Sony is apparently infringing on two of LG’s patents with respect to how the PS3 renders Blu-ray data. LG is demanding an “immediate investigation” by the International Trade Commission and wants them to halt sales of the PS3 in the United States. Wow, imagine that.

It makes me wonder what took LG so long to figure this out; I mean the PS3 has been on store shelves for nearly 5 years … did LG jailbreak the PS3 in order to find and claim patent infringement?

Suggestions that Sony has added a rootkit with the latest firmware update to its PS3 console have been denounced as bunkum by a leading gaming security expert.

Rumours began flying on the interwebs earlier this week that the official 3.56 firmware upgrade for Sony's consoles gave the consumer electronics giant the ability to execute code on the PS3 as soon as a user goes online.

Sony can use the technology to verify system files or to look for home-brewed games, it was suggested. More sinister still, it was warned, the code can be updated without further firmware updates.

But Chris Boyd, a security researcher at GFI Security who has studied the security of online games for several years, points out the development is not new since Sony wrote the ability for it to do remote updates into its terms and conditions since at least 2006.

"It's been known for a while that a networked PS3 will contact Sony servers at start up (whether it has an active PlayStation network account on it or not), which performs various tasks related to error logs, updates and other activities," Boyd (aka Paperghost) told El Reg.

Anyone using a PS3 agrees in the terms of service to allow their console to perform these tasks.

Mark Russinovich found a rootkit in Sony CDs back in 2005, provoking a huge privacy outcry. This has led some enthusiasts and bloggers to suggest that history is repeating itself with the PS3 firmware upgrade.

The PS3 firmware upgrade is nothing like as malign, argues Boyd, who has spoken on X-Box and online gaming security at several security conferences. "Comparing a last ditch attempt at blocking hacks and custom firmware to the truly dreadful CD rootkit is mind boggling."

PlayStation 3 jailbreaker George Hotz must allow console-maker Sony to comb through his computer’s hard drive and retrieve information “that relates to the hacking of the PlayStation,” a federal judge ruled Thursday.

U.S. District Judge Susan Illston’s ruled from the bench in Sony’s ongoing legal action against the New Jersey hacker, who goes by GeoHot. The lawsuit is in connection to the 21-year-old being the first to fully hack the 4-year-old console, a jailbreak allowing it to play pirated and home-brewed games.

Hotz posted the code on his website last month, and put a how-to video on YouTube. That landed him in court here on Digital Millennium Copyright Act civil allegations. Among other things, Sony accuses him of trafficking in devices that circumvent controls meant to protect copyrighted works.

In the Thursday hearing, Hotz’ attorney, Stewart Kellar, objected to the judge’s bench order, saying Sony would be able to “observe” the contents of all his client’s files.

“That’s the breaks,” Illston said.


Hotz has already removed the YouTube video and the code from his website to comport with the judge’s earlier orders.

The judge had originally ruled weeks ago that Hotz must surrender all of his computer gear to Sony. But Kellar asked for reconsideration, and a hearing was hastily called Thursday

Illston informed Kellar that it was routine for the entire contents of computers to be searched in a bid to isolate what is being sought, as in child pornography prosecutions.

“Your honor, we’re certainly not dealing with child pornography in this issue,” Kellar replied.

Moments later, the judge responded:

“Here, I find probable cause that your client has got these things on his computer,” she said. “It’s a problem when more than one thing is kept on the computer. I’ll make sure the order is and will be that Sony is only entitled to isolate … the information on the computer that relates to the hacking of the PlayStation.”

The DMCA makes it either a civil or criminal offense to traffic in wares meant to circumvent devices protecting copyrighted works. Performing a similar hack on a mobile phone is lawful.

Sony’s attorney, James Gilliland, was quick to point out to Illston that the mobile phone is not at issue here. “The conduct Mr. Hotz has engaged in is still covered by the DMCA,” he said.

The judge also backed off on an order that Hotz “retrieve” the code from anybody who he may have forwarded it to.

“It’s information. It can’t be retrieved. It’s just not practical,” Illston said. “What would they do, Xerox it and mail it back? ”

Illston said she changed her mind because she was not clearly aware of the details in her earlier order.

“This kind of got away from me and I apologize for that,” she said from the bench.

The judge ordered Sony and Kellar to confer with each other on the parameters of where and when Hotz would allow Sony to sift through his computer. She also ordered him not to delete or modify any files connected to the jailbreak.

Meanwhile, Sony is threatening to sue [.pdf] anybody posting the code, even though Sony accidentally tweeted it earlier this week.

Sony’s attorney, Gilliland, said the Japanese console maker has been sending out an undisclosed number of DMCA “takedown” notices to websites demanding the code’s removal.

Sony is also asking Judge Illston to order Google to surrender the IP addresses [.pdf] and other identifying information of those who have viewed or commented about the jailbreak video on Hotz’ private YouTube page. The game maker is also demanding that Twitter provide the identities of a host of hackers who first unveiled a limited version of the hack in December.

A hearing on that is scheduled next month. Sony is seeking unspecified damages

I think someone will have the balls to release a new CFW 3.56 but as of right now id lay way low if i was a hacker...Geo is suffering because o it and i doubt they want that to happen to them.
