You did when you updated to 3.55 which also stated that you cannot modify your system or run unauthorized software. Plus, in order to be permitted to use the PSN, you are required to accept the TOS. So, if you bypass the TOS, you do not have permissions to use the PSN. And by using the PSN anyway, Sony has the authority to ban you.

Actually, if you were on 3.41 and waited for custom 3.55 firmware that didnt have the TOS, your fine. Yep, that's right. For the psn part about using your services, your right. But who cares?
