For those wondering what's been happening with the OtherOS lawsuit... Sony Computer Entertainment America (SCEA) filed a motion to dismiss. The court granted the motion but only partially. It has dismissed all claims against Sony except for one... the allegation that SCEA violated the You must login or register to view this content.. To establish the implied warranty of fitness existed, Plaintiffs must allege that SCEA had “reason to know” of their special purpose, i.e., to use the PS3 in perpetuity for all advertised features and functions including the Other OS; that Plaintiffs relied on SCEA’s expertise; and that SCEA had “reason to know” of their reliance on the continued availability of all features and functions. Plaintiffs have not only failed to allege these requisite facts, they indeed cannot due to the explicit language of SCEA’s Warranty, SSLA, and Terms of Service. Specifically, because SCEA had the right to terminate or alter any feature or function, it had no reason to believe that Plaintiffs purchased their PS3s particularly with the expectation and belief that all features, including the Other OS, would be available for the “life” of the PS3.

Sony is arguing that your system needs to keep all the features it was sold with for the length of its warranty, and then after that time, removal of any function is fair game. "I think the problem is that in order to accept the notion that Sony made an unauthorized intrusion onto the plaintiffs' PS3s, you have to start with the assumption that what was 'disabled' was something that the plaintiffs had an ownership interest in..." Sony's laywer argued.

He continued, saying that gamers had a choice. "We're talking about if you are so interested in keeping this one feature, then you're not going to be able to access the PSN anymore. You may not be able to play some games. But that is not hacking into somebody's computer, which is the essence of the [Computer Fraud and Abuse Act]." This isn't a matter of accepting or declining a software update, it's the problem of Sony placing consumers in a position where they lose functionality no matter what they do. That may be a tough sell to the court.

lol, this is only good news for 5-10% of the ps3 community. The rest of you are LEECHERS who don't even know wtf linux is and what it does. You are like mwahaha "Sony got pwned, sony got karma etc..." but why? WTF would you do with linux? Do you even know how to use it? Do you even know what its capable of? Could you maybe use the half brain that you might have and think about what the linux could do on the ps3? No, you can't because you are in idiot. If geohot could do this without the aid of linux, think about what would happen to the ps3 if linux was still available before you keep going "yay, sony got pwned" PS3 WOULD BE LIKE THE DREAMCAST, A DEAD CONSOLE

Aren't you cool talking down to a forum full of people you know nothing about? I stand in awe of your implied "leetness".

The fact remains Sony took the easy way out by removing the other OS feature, it is not beyond their capabilities to secure their system from the other OS. It's just easier to remove it altogether. Would some people be able to rape the system despite this additional security? Of course they would, but it would be a very small percentage of people. In fact it would probably end up being the same people that do it without linux.

huh? I know quite a few people on NGU who know what they are doing and will tell you with 100% gurantee that most members of NGU are leechers. Don't believe me? Look at MW2 on ps3. How did private hacks find their way to everyone's ps3? I wonder... Let me go to NGU.com and go to MW2 hacks and exploits... The PS3 ban has already been bypassed but why do you not see it here on this forum? Because the people who put their work into it see that others just copy and paste their work and make it public when it shouldn't be.

The whole OtherOS is a complete bs lie that geonubz came up with to try and even justify why he's doing what he wants to. Let's get real. WTF homebrew can you honestly run on the ps3 that you can't run more efficiently and better on your pc. What homebrew do most people want to run on ps3? "Free Games cause I'm so cool and Poor" Geonubz did what he did because he wanted to get more "famous". I pray Sony analy owns him and others like him and makes an example out of a few select jailbreakers. You don't think geonubz would go after ps3 if it had OtherOS? you bet he would. It's just a lame excuse people use when someone asks them why they Jb'd. Do people even know wtf the OtherOs is and what it would do let you? Of course Sony took the easy way out. What, do you want them to make it easy for them to pirate games? This has a much larger impact than your ability to run "I can graph" on your ps3 and then your need to play games for free. People need to pay for their s*** because that's what makes the S*** so good.
