Well, new ones should be 3.55 or lower (or so I've heard). Refurb'd ones are hard to tell. Ask when it was sold to the store. Even if it was a long time ago, theres a large chance the store has the latest, or higher than 3.55 atleast, FW on it. Just take it back and make some excuse if it has higher than 3.55, or directly ask what firmware it is.
