A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

The game doesn't know the difference between hack and legit.
All Achievements Unlocked: FALSE.
100% Completion on Campaign, Spec Ops , Multiplayer (1100%): FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

that would be only thing that comes to mine but someone would have it by now,
i was reading a few pages back and they said the
1k ac-130 kills emblem spinned clockwise and they said skull spins counter-clocwise. someone else then pointed out some killstreak embles (ie 50 uavs, carepacages, ac-130s) move same way as skull. so could it be call in 50 or x amount of all the killstreaks(hoever many needed for emblem) when ur 10th prestige. this could be a hidden challenge for it

As far as I know you can only get the sticky from the modded lobby, which goes away if you change your emblem. To get it perm I'm pretty sure you need to have a J-tag of your own, or get someone to do a system link lobby for you like I did xD (correct me if I'm wrong). But no it can be obtained through normal gameplay as Robert Bowling said, check the first page if you haven't yet.

listen to this. im starting to think even more outside of the box and whats even more freaky is that im starting to have a dream about this; i had one a night ago.
more random but maybe theres some sort of clue in single player maybe that gives us a combination of buttons to hit on the controller when the padlock is highlighted. i know, its kind of sega genesis-like to me, seeing it as not being any sort of challenge and all people are thinking about is different sorts challenges.

i think it could be somehow linked to the last levels of single player or spec-ops but idk about a button cobination.

yea i doubt it too but im starting to move away towards multiplayer and closer to spec ops and single player.
beating all of IW best times in spec ops would sound the most plausible but someone possibly could have done that.
