A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

All Achievements Unlocked: FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

Heres another theory, The challenge pr_marksman_ak47_4 (which as far as we know isnt in the game itself just the coding) means Prestige AK47 Marksman, which basically translates to AK47 Veteran IV. Beside the challenge in the coding it reads "level 70" so obviously you'll have to be prestiged at least once to get the prestige challenges and 70 to unlock the AK. Right so why would it say pr_marksman_ak47_4 and not ak47_veteran_4? Im thinking that maybe IW gave us a hint in the coding (Why else would it say "level 70" right beside it?) When you complete AK47 Marksman 4 you unlock the ACOG sight, 402 already said to get this you would need dedication so what im thinking is 10,000+ kills with the AK47 w/ ACOG. Might be a bit out there but its not dis proven yet.

not a bad theory mate but i dont think that is it. the levels being displayed in the coding are zero based, so level 70 means level 71 which also doesnt exist. in the coding it also says you unlock the ak at level 69. iw just messed up the coding. of 6 million+ players no one has it legit, thats just impossible. and i also think someone would really love the ak with the acog sight and has a lot of kills with it, it would have been known.

Mabye a certain amount of kills with the AK47 w/ Acog and Red Tiger camo considering those two items were the 2 top things you could unlock in CoD4

Guys, CoD MW2 has been out for a while now and its not possible that out of all the players, none have it (without hacking). The way to get it is to keep asking IW or Robert on Twitter. I think when they notice an increase on people asking, they'll confess. Either they screwed up somehow or the challenge is really something nobody thought of yet.
