A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

All Achievements Unlocked: FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

well i have a friend who says he unlocked it by himself
all challenges
all accolades
i was playing with him he was trying to finish the last challenge for him the one from the stinger....
we were playing mosh pit when i heard the sound when you complete a challange and he just yelled i finally got it !!!!
on the next game he show it up
i dont know if real or hacked but i believe in him
he is one of the best (if not the best one) legit gamers in colombia

Also you have to take into consideration there are secret challenges not posted in the challenge board. Like for instance... Get One NinJa Defuse: Defuse a bomb while the planter is still alive. or Renaissance Man : Get 3 Kills with 3 different weapons in one life. All of those must be completed as well.

Look if you dont have a vid or any proof dont post about how your friend has it its just a misleading waste. If we really want it legit or find out if its possible to get it legit why dont we just spam the hell out of fourzerotwo's twitter all asking him over and over until he breaks, other than that pay for a CL to get the emblem and move on to black ops!

What about...
Play EVERY game mode top to bottom without using any killstreaks and come top of every game?
Because its the 10th spinning from MW2 it must be something to do with being the best at MW2...
So get somebody to try this...
Set up one class they're going to use throughout the entire game.
Remove all their kill streaks.
Play the game modes top to bottom and win every game.....
