A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

The game doesn't know the difference between hack and legit.
All Achievements Unlocked: FALSE.
100% Completion on Campaign, Spec Ops , Multiplayer (1100%): FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

lol yea, i think he retired or something. might have been his pay. anyways, the only way is to spam 402 for a hint at least, saying if its a hidden challenge or something we could actually figure out.

Yeah I think he should give us a hint. I feel lost in my motivation for finding it lately, maybe if he gave a hint I could feel motivated...but that's up to him.

So what happens after someone finds the spinning skull emblem?
Obviously most of the people on this site would die for the emblem so heres what i think would happen if one person found out, knowing the rareness of the emblem...
1) They'd brag about it, make a video of it and show it off for the longest time to get attention without actually telling anyone how to get it.
2) They would get the emblem for you for high $ or other trade (maybe for free but unlikely) but, again, not release the directions of how to get it and would get as much profit as he could out of it.
3) They would sell the directions of how to get it to people, probably people he closely knows.
4) The people who he now told would now do everything from 1-3 hoping to make a profit.
and...
..5) Maybe, just maybe, this guy who finds it would first release that he found it, and prove it, and get ALL the attention he would ever need on this site then release the directions and a tutorial for free to all members of this site (or even premium)
In all honesty i would love to have this emblem, it would be so sick, but i just hope the person who finds this isnt a person who would try to make a profit out of it but just release it to all.

well a few of my friends from here who are on the hunt have agreed that when they find it, they will share it with their closest friends, brag for about a week, than tell everyone how to get it
