Although they issued a terse, general comment on the matter late last week, Sony has for the first time responded directly to hackers who dismantled the PlayStation 3's software security, and unsurprisingly they did so with lawyers. George Hotz and members of the group fail0verflow have been hit with a lawsuit, accused of circumventing "effective technological protection measures" in the PS3 in a way that would knowingly lead to increased piracy.

Sony alleges the defendants (which number over 100 named in the suit) violated the Digital Millenium Copyright Act, the Computer Fraud and Abuse Act, the Copyright Act and related state and common laws covered by the California Comprehensive Computer Data Access and Fraud Act. All if this comes by way of the legal documents Hotz was served, which he published on his website (via GamesIndustry.biz).

Sony is seeking a Temporary Restraining Order, Order to Show Cause, and Order of Impoundment against Hotz and the other defendants, claiming that if they don't turn in any hardware or software used to circumvent the PS3's security, Sony "will suffer irreparable harm." The restraining order would also prevent them from further spreading any circumvention technology online, or from accessing the PS3 to obtain any further code or information from the device.

The move, though, seems more punitive than preventative; the fact remains the root key is out in the open, and striking back at Hotz and fail0verflow -- while probably justified under the law -- likely won't in itself do much to counter whatever consequences this chain of events will lead to. As for what more Sony will do to attempt to repair the PS3's security going forward, that still remains to be seen.

Do or Do Not, There is No Try
This won't uphold in any court for more than a few days. There has already been legal precedent in this similar situation against Apple. Steve Jobs and his crew went the legal course against jailbreaks as well. We all know what happened there. He lost, and lost quite dramatically. The higher courts ruled that Jailbreaking is completely legal under all laws. If piracy happens, then it will happen. They can only punish those that commit the piracy. So as previously stated, this will be another epic fail for Sony. They have no hopes in court, they can't prevent anything as the system is completely compromised, and they will go bankrupt if they sue every customer they have. Epic fail for Sony.

This is true. At the end, Sony won't win, they'll waste all that money on this poor executed case, if you can even classify this as a decent lawsuit, and well, the hackers will win. Sony should have just accepted that the ps3 is now hackable, and left it at that; Maybe they should try to find ways to stop the current predicament, like they did by updating the ps3's security through firmware, instead of trying to sue nerds. lol A sad day for sonyyyyyy. What if a 12 year old dismantled the PS3 security, then what?

hmmmm i look to the past with all the older systems when there used to be game shark that would let you essentially hack the system to give you the same stuff as cl's but times have changed, what is jail break but a better gameshark except for the piracy part of it. myself i do not condone piracy, but i do say we do need the ability to do a copy of our games and dvd's cause they r our property. if that is the case then why didnt they sue gameshark and in the beginning sue everyone who participated in the making of the vcr and the cd burner and the programs that let you make copies like that. but i guess i dont understand all the stuff enough to realise it well this is just my thoughts. shit even the systems had cheat codes that were built in and if you do read the whole EULA if you find cheat codes in the game you are not even supposed to use them which is BS lolcause it breaks it saying that it gives you a unfair advantage just like glitching
