Do not listen to the OP. He is wrong! You can get console banned even if you do not accept the terms of service agreement. Technically speaking, they do not show you the terms of service agreement. They show the system software license agreement.

Here is the first paragraph of the agreement:
"SYSTEM SOFTWARE LICENSE AGREEMENT (Version 1.4) FOR THE PlayStation®3 SYSTEM
December 10, 2009
PLEASE READ THIS SYSTEM SOFTWARE LICENSE AGREEMENT CAREFULLY TO UNDERSTAND YOUR RIGHTS AND OBLIGATIONS."
See how it says December 10, 2009. They have not changed their SSLA since then. So it is the exact same as the previous one you agreed to. You can even look at posts on this board where someone mentioned that it was weird that it said December 2009. Now, this should clear up all the confusion over these agreements.
Even if you want to argue that you did not accept the SSLA from Dec. 10, 2009, then here is Version 1.3 of SSLA from Sept. 1, 2009:

Compare these two versions of the SSLA if you want. They both contain the paragraph you mention in your post.
