You have any proof of the convo between the kid and your brother? if yes show it to them and then they can verify that it wasn't your brothers fault

I tried that and they said "It is not our fault you picked to go on his account. We recommend that all users should not let any other users on their account."

Okay look, tell them that you have proof that you had permission , they cant denie that you didnt have permission because you have proof and since yo had permission that cannot ban you because i think the kid said you were on it without permission right?

oh i was banned for a month 4 something on the same lines sony believe anything they get told and i rang and explained what happened and i only got banned 4 1month

Nope
No way of unbanning once they perm a account.
Unless you phone up sony and talk to them but i doubt it going to help you at all. Your lucky they did not console ban you on top.
