Am not trying to be an smart-azz or nothing so you telling me he won't issue a refund nor give me the item I purchase from him , that don't entitle him to a ban? So all he has to do is check in the dispute everyday and give an story for why he don't refund or give me account and that's it.

You need to reply to the dispute. You come in here once just to say a remark with no proof. Check the dispute everyday and reply if there are new disputes. If you keep ignoring it you will be banned for scamming. For all we know you could have two ps3's and be logged on both.
