They aren't patched LOL!
They just hotfixed all the old saves you just have to get a new one

if you are doing the save game mod to od solo or co-op, co-op is patched, BUT solo you can pull out your ethernet cable or disconect xbl laod up the save game then re-connect your ethernet cable or to xbl and bingo
