Well if u dont get caught, then your safe, however if microsoft do catch you then they will definitely ban you from xbox live no questions asked.

"stealing" is the keyword. I think you can get in trouble for that anyway you look at it. Its hard to get caught because, the person would have to go to drastic measures to catch you, but I highly doubt anyone would be that desperate for an account.
