Did he say anything about this issue in the description of the product you purchased? If not, then contact him.

Well then that's on you bud. There is really nothing you can do, except get it repaired.

Nothing is really ILLEGAL to do to your Xbox, it's just if you mod it or something then it Microsoft won't fix it for you. So if he did then you can't send it to a repair center. Usually there's a person around that fixes Xbox's for a very low charge and he don't care if your Xbox is modded or not. Try asking around and I'm sure you will find someone to do it.
