n April the International Trade Commision’s (ITC) Administrative Law Judge, David Shaw, decided that the Xbox 360 was in violation of four patents held by Motorola Mobility (now Acquired by Google). At that time Judge Shaw made no recommendations as to how to handle his ruling, but a court document was released to the public on Monday that now included such suggestions.In the document, Shaw states Microsoft feels that banning their console in the US would be “contrary to the public interest,” as it would leave only Sony and Nintendo to compete in the home console market. However, Shaw explains that he believes “Enforcing intellectual property rights outweighs any potential economic impact on video game console buyers.”

Shaw recommends an immediate cease and desist on importing Xbox 360 consoles as well as a ban on retail outlets to sell current stockpiles of consoles and accessories and also recommends Microsoft be fined the equivalent of the value of all consoles currently sold in the US. It is currently unclear if any such ban could include the sales of software or just hardware.

While a similar ruling took Xboxes off the shelves in Germany earlier this month, we’re still far from seeing bare spots on the shelves where the consoles used to sit. Shaw’s recommendation still needs to be reviewed and approved by the ITC’s Board of Commissioners followed by an ultimate decision by President Obama. The whole process currently has a deadline of October 21st.

It’s difficult to tell how the coin will fall for the 360 at this point but I might hold off on buying any Microsoft stock for a while.
