Just did it with a friend as I'm typing this, its not patched.

IT is patched, In the playlist update.. I prestiged to lvl 3 and then i quit game cause i couldnt join my friend cause different playlists and i decided to go to 4th and it didn't work. PATCHED =/

It is patched. Recently, if you haven't turned off your ps3 then you can still do it.

IMPORTANT: If you are still currently ranking up, DON'T TURN YOUR PS3 OFF or CLOSE BLACK OPS.
The glitch will still work if you haven't turned off black ops since they did the patch. I just did it for someone else and it still works.
