(adsbygoogle = window.adsbygoogle || []).push({}); Right, PS3 users have gotten a game with constant lag and errors.

Legally we are allowed a full refund because the product does not meet specification and therefore was falsely advertised, if online play has become unplayable for you contact treyarch or the store you bought it from and try get a full refund as legally we can.

I'm starting to get freezing problems after the latest patch, along with lag. I don't think I'm going to do this because I still can play. But thanks for the info.

Unfortunately it is playable, just bad- meaning you can't legally get a refund.

If it is so bad surely it must count as unplayable, like you dont move for 5 seconds on your screen then you teleport half way across the map. That to me is unplayable.

Not exactly.

Technically, Activision never said the game wouldn't be worse on PS3, and they didn't say there wouldn't be lag online, and as long as you can actually find a game then online is still, in the eyes of the law, playable.

The only way you can get a refund for the game is if the person at the store who sold it to you specified that the PS3 and Xbox versions are of the same quality or that there isn't any lag online, then you can threaten to sue the store for false advertising, or, if you're in Australia, Misleading and Deceptive Conduct.

The reason you can't get a refund legally is because the only way you would be able to is to threaten a law suit for False Advertising, however, False Advertising doesn't incluse lying by omission, which is what Activision did by neglecting to mention that the game was worse on PS3...

So don't just barge into your local game store and demand a refund, because Activison aren't legally responsible for providing you with one.

Good post, I didn't see it like this, but I am sure someone is looking for adverts and and trying to find loop holes to get refunds.

seeing as I am getting a bit bored of the same errors I got MoH for christams but the gameplay is so different and I am not sure I like it.
