Not really. Nothing is being sold under the domain. Even though it redirects to a page when you can buy items, it still isn't technically under the Modern Warfare 3 title. Also, whoever did it can't have any actions taken on them since they own the domain and as far as I know nothing illegal is happening under the domain. If they however started selling their own products on that domain then there would be an issue. Even though it might not be the same thing, it can still be taken down...kind of like how an Oregon coffee shop sold their products under a logo with a mermaid that apparently looked too similar to Starbucks' logo.
