My question is that if you backed up your 3.xx data to an external hdd, data transfered your patches over then restored your data would you still have the patches you data transfered or wold they be overwritten by the backup?

no you wont because the backup will delete what's on the 3.xx HDD, and restore the backup from the external HDD

^^ Yeah, the transferred patches would be overwritten/deleted by the backup.

If you install a 3.xx spoof on your CFW, you can data transfer from OFW to CFW, add the modified patches then transfer back again. Just make sure to always keep backups of any files you replace
