1. Can the CFW be detected and is it illegal?
2. Is there any risk of being banned by Sony - should i not sign into the playstation network or anything like that?

If sony cant see the CFW at the moment they will soon implement something so it can be seen just like microsoft did with the 360, then let the ban wave begin.
