Define renting?
Renting is defined as "The act of paying for the use of something."
So as long as you keep paying gamefly it is legal to back up games.

Up until the point you return it, then you are not renting, you are paying for the use of something else. You could use it as a backup without it being piracy up until the point you returned it.

If they dont explicitly state that then it is legal also anything not illegal is legal. If it does state that somewhere post a link or screenshot.
