I highly doubt Sony will win their case against either party (Geohot or fail0verflow. Especially fail0verflow due to the laws in their country) and the fact that every PS3 that is unlocked right now is a homebrew-capable tool. The same thing happened to Xboxs (JTAG hack) and JTAGs are still pretty available and there's a good market for them.

Also, since we have the keys to all of the PS3's system, any update wouldn't technically get rid of jail-breaking, it would just take a different method to do so.

Well thats weather or not Sony wins and what the judge decides at the court case.
And im sure the new FW im assuming 3.60 I will get CFW hacked again, maybe not by geohot or Team fail0verflow. But using some of geohot's or fail0verflow's tools it could be hacked again.
If people are worried about getting banned just install the OFW 3.55 back onto your ps3
