Post: Terms of Service loophole
01-20-2011, 08:34 PM #1
(adsbygoogle = window.adsbygoogle || []).push({}); So, I decided to read the Terms of Service thoroughly and found a loophole in said document.

You must login or register to view this content.

You must not modify or attempt to modify the online client, disc, save file, server, client-server communication, or other part of any Service or cause disruption to any account, system, hardware, software, or network connected to Sony Online Services for any reason, including to gain an unfair advantage in any Service.

This basically says that we'll get banned if we hack using CFW. However, if we modify prior to making a PSN account and agreeing to the terms of use then create a PSN account, we won't be violating any rules and they cannot ban us for that.

We would not be violating the terms of use post agreeing, thus they cannot ban us.

but surely if you was made aware of that point while reading the tos you would not be able to agree to it? if your trying to prove that the cfw in question was not being used for illegal purposes then morraly you would decline when asked.

Not if you did CFW before making a PSN account :carling:

I see what you mean, but sony could easily turn around and say that if you modify it before you have accepted ToS, and then accept it, that your previous modification of software might still count against you.

You didn't read or accept it before the fact, so it couldn't be held against you. Unless they state it specifically in the ToU then you shouldn't get banned.

exactly thank you for wording it propperly, what i ment was agreeing to the tos knowing that you have modded your ps3 is the same as modding it after agreeing, your still in the wrong

Yea, it's basically like holding a gun to someones head and a Police Office saying not to pull the trigger, but you're just tempting the Officer and he dares you to pull it... so you do, now you pay the consequences.
