1. No, Sony could never patch data transferring. Most people use it for legitimate reasons. Patching data transferring from CFW to the newest firmware is also not going to happen, but
even if it did, you could put on 3.55 OFW temporarily, data transfer and still have every single aspect on your 3.72+ still. This is because..
2. Homebrew cannot be used on OFW, so you will not be able to change patches, download free games, hack trophies, etc. You will just have the modded game data still on your 3.72, working.
