A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

The game doesn't know the difference between hack and legit.
All Achievements Unlocked: FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

Well as everyone can see in the emblems menu, the 10th spinning skull is along with all of the prestige challenges, and maybe, you need to get 1000 kills with no killstreak rewards used? Maybe that's why they give you the ability to not use any (at least I think you don't need to have any equipped). And 1000 kills with no killstreaks equipped sounds like it could be a challenge. And it would explain why nobody has unlocked this emblem, because who would go 1000 kills without killstreaks xD.
Or get a certain killstreak with no killstreaks equipped.
Edit*- I don't believe ak-47 challenges on 4th prestige is correct, because I don't think they'd make people suffer for going past 4th prestige.

possibly, or think about this. destroy 1000 killstreaks (uav, sentry, harrier, heli, pavelow, chopper, ac130) with emp. how often does an emp get used? and it is the next killstreak up (although people said the nuke is) after ac 130 and neither the emp or nuke is in the prestige challenge section. 1000 emp would sound tough tho but call about 400-500 of them destroying at least 2 each emp.

Yeah I think 400-500 emps would be a little much xD. But something to do with emp or nuke kills sounds possible just because those 2 aren't in the prestige challenges. But I think 1k nuke kills has been proven false, but not sure.

yea i would think so too. just think what people dont do often. i said a throwing knife, emp, etc. could be something ridiculously simple to boost and takes 1 match and that might be why no one is giving out how to earn it.

It is unlockable but in a way most wouldn't expect.
It's been proven that you need to complete Ak-47 Marksman IV which doesn't exist.
There obviously is a legit way to unlock it, as 402 stated. But as of now the only confirmed possible way is the Ak Marksman thing.
