A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

The game doesn't know the difference between hack and legit.
All Achievements Unlocked: FALSE.
100% Completion on Campaign, Spec Ops , Multiplayer (1100%): FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

Hey all, im back again. Reading through the posts after my last comment I think we are definetly thinking strategicly atm. 
As -Ct3x- stated there is a very good chance that it's only for 10th prestigers.. Meaning that it's possibly something to do with a combination of titles and emblems. Think, what is only accesible to 10th prestigers... I though Prestige 10 title and the Normal emblem, link them up, do a secret challenge = spinning one? Although no clue on secret challenge, and that could be anything
Im up for teddy hunting on PS3 anytime, Add Dayshade. I'm also learning to quickscope and appreciate all help

yea, that's what i said about wearing tenth prestige title and emblem. so that's what i'm gunna try. maybe wear that while completing all hidden challenges or something i dunno.

yea i gotcha, i have every title except for the mastery and veteran challenge ones though. meaning i have every "graphic title" as i call them. and i have every emblem on pages 1-4 except spinning skull on 4. and i have all of them on 5 except the gun emblems too. but it has been proven that even with every title even the mastery and veteran, and every emblem (inc. gun ones) it still doesn't get you the spinning skull. so it's not complete all challenges.
and to those who think "if you hacked it triggers something where you can't get it" that's wrong because: 1. they didn't know we were going to hack so how could it have set something off with the coding. 2. they fixed hacking in later update but didn't sort through those who did and didn't and they probably would've stated that this emblem was being done away with for hackers if that were the case. just my opinions though, so everyone try to find ways to get the emblem and we will probably figure it out sooner or later. and make a twitter account and ask fourzerotwo if it's available on ps3 and ask for a hint as how to get it!!!
i think it might have to do with teddy bears, the nuke, or ak47, or maybe viral where you have to be tenth prestige level 70 and knife a tenth prestige level 70 wearing this emblem. who the eff knows? so keep doing what you're doing on the project. i'm glad to see everyone on here is being active towards this and wants it just as bad as anyone else. teamwork is grand and appreciated.

well i know an easy way to get all the 1000 things called in if you can resistance bypass or something. and if you join my boost rooms it will be easy. i did my attack helicopter in a boost room. ant came up with an idea that worked really well.
i also think shooting it will locate u faster because u get shot in 3 seconds if a harrier is facing u and youre shooting it. if youre in back of it and shoot it i think it will turn around to kill u no matter how many people its facing. not too sure but want test this.

yea i dunno. i've been reading and apparently people on xbox forums claim they've found some clues in the new maps. but i dunno. and i've read if you're sitting by a teddy bear when a nuke goes off you won't die. lol... and i've read you might have to get all golden guns on cod4. and i've read that it's not unlockable YET for anyone. but that's a lie as fourzerotwo has said.

yea, there is a teddy on Salvage torn up with that dudes name next to it and i think a second teddy next to it. thought that might have been a clue
