A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

The game doesn't know the difference between hack and legit.
All Achievements Unlocked: FALSE.
100% Completion on Campaign, Spec Ops , Multiplayer (1100%): FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

Im assuming every challenge. 2.5k kills with everything. All the guns. Then all the headshots. Then all the other shit. Like game winning kill cam with a crate on a noob. Every challenge done. Idk whats more dedication. I don't think they want someone with a life to have it.

I highly doubt it has anything to do with teddy bears.
You could find all the of them before you even prestige once and that wouldnt make sense since the emblem represents 10th prestige.

MY THEORY:
i dunno why but i have a feeling it's some how linked with cod4. this is my very first theory i came up with but i dunno. all challenges on here and cod4? dunno. i just did some math and if you tally up 150 headshots for each cod4 assault rifle it equals 1,050 headshots. on mw2 it takes 1,000 headshots to make for one weapon mastered. if you master all the assault rifles on cod4 you get the golden ak47. if you master the gun on mw2 you get a gold title. i'm still kind of leaning toward the skull and cod4 are linked together. think about it, the very last prestige challenge you do is the ac130, and u unlock the spinning cod4 tenth prestige. i'm thinking you have to do stuff on cod4 to unlock the spinning codmw2 tenth prestige. as well as complete other things on mw2. until this theory is proven wrong, this seems to make the most sense to me honestly. and why would they still keep some of the same challenges as cod4 had too. i dunno, maybe i'm completely wrong or completely right. i'd like to think that i'm right about this, but could easily be wrong. it seems logical to me as they still brought all the cod4 emblems in mw2. i dunno. have fun

oh nice, my cuz is a gym teacher and wanted to be also but not that into it anymore. ill probably go to the art institute or something after 1 more year of college.

that's awesome man, and i might wanna do something with music too. i'm a really good drummer, i actually just got done playing. and check out my old old theory and see if it seems possible. under why the tenth prestige emblem thread.
