A lot of people are posting the same theories and mixing up the emblem with the COD4 one. The COD4 one, which is shown below is obtained through the Spectre IV challenge completion:

THIS IS NOT THE EMBLEM IN QUESTION. The emblem we're trying to unlock is this one:

According to 402, this emblem is obtainable in the game without hacking or modding. Proof of him saying this is shown on his Twitter account as well as the pictures below:

So now that you all know what emblem we're looking for, here are some of the THEORIES that people have thought of and proven to be wrong. Also, no one has obtained this emblem without hacking the game.
THEORIES IN THE TRASH:

The game doesn't know the difference between hack and legit.
All Achievements Unlocked: FALSE.
100% Completion on Campaign, Spec Ops , Multiplayer (1100%): FALSE.

This would take approximately 112 nukes but if you want to be realistic and say 6 kills per game, you would call in about 167 nukes)

Complete all HIDDEN Challenges: Hackers have pretty much found all of the hidden challenges in the game and completed them. The game doesn't consist of many hidden challenges and even if it was a hidden challenge, then modded game lobbies would unlock every challenge despite it being hidden.
So there's the few theories many of us have gone through in order to get this emblem, and thus far, we're pretty much out of luck and ideas. Hackers have looked into the .csv (game codes) to find something that may stand out, and so far the only thing they found is the following:
"level 70 and pr_marksman_ak47_4"
You have to be level 70 to unlock the AK47, unfortunately the Marksmen challenge only goes upto 3 (III), which doesn't help us at all.
It also doesn't have anything to do with any of the DLC content as 402 said that the emblem was obtainable on the PS3 way before the first DLC came out.
Post any new theories you guys have. We're going to find out how to get this emblem!
Also, please refrain from posting theories that have already been proven wrong. We need NEW ones.

i know it would be alot work but thats the logic reason i dont think shooting teddy bears can be it to get the spinning skull emblem. he said it takes dedication whats more dedicated then that thats my opinion

true, we cant really put down any theory at this point but doubt this since many people cant do this imo.

ha, ya true. i dont think it has to do with a specific weapon tho. maybe with the ak 47, could it be challenge IV?

No matter what it is, 402 says it would take dedication. Maybe there is something with the AK, or nukes, or just some sort of challenge pattern... someone will find out. =D

yea i agree, it will be figured out sooner or later. i just hate this guy plus, hes keeping secrets >

what i have currently found out: there is a stinger veteran IV prestige challenge which is to shoot down 5000 helicopters. and since the ak47 apparently has a veteran IV or mastery IV (which ever one it is) it could be to get 5000 kills or headshots being 10th prestige level 70. and since i doubt people use the ak47 that much it could possibly be that. or it could be the teddy bears, or it could be anything. all i'm saying is there are no dumb ideas, seeing as it's still unconfirmed on how to get it. but only dumb ideas are people saying "complete all prestige challenges" cos it's obviously not that.

no problem. i have like 300 something now and doubt i will be at 5000 by 9th prestige. matter of fact, perfect because im going for 1000 copters this prestige. also ultimate sacrifice.
yea thats all true. constantly use the ak 47 if u want. possibly shoot all the teddys with the ak at 10th prestige, idk could be the most random thing.
