I have started this thread to discuss weather or not it is right for Team Fail0verflow and George Hotz (geohot) to get sued by SCEA.
They are pretty much sueing geohot for releasing the PS3 System Root keys to the public via Internet. But there is not copyright law against numbers or sequences of numbers.
Also releasing the 3.55 CFW Jailbreak, Jailbreaking is not illegal, even under the DMCA, as it is just allwing users to enjoy freedom they should have with a PS3 Console.
One the court papers that have been released on geohots website (geohot.com) stat that pretty they have opened up the console for piracy. But as you might of seen both geohot and Team Fail0verflow have stated that they do not condone piracy. It they didnt even release and piracy related .pkg's in the CFW.
Also apparently according to SCEA Homebrew is illegal which its not under the DMCA. Also the Jailbreak Firmware is technically not a Jailbreak that you would get from a modchip. Because Jailbreak modchips disable all the TMP's and Rootkeys signings, so Homebrew dont need to be signed to be install. On the Jailbreak Firmware any Homebrew as to be signed with the PS3 Systems root key. So technically speaking it is a Offical Sony pachage because it been signed with Sony's keys.
Personally I dont think SCEA are going to win the courtcase, Because of what they are sueing them for is just ridiculous. Also if if where SCEA I wouldn't sue George Hotz, I would hired this smart kid to encyrpt Sony devices.

Actually jailbreaking IS illegal on ever device unless stated otherwise. Jailbreaking the iPhone, iPod, etc. was illegal for the longest time until recently a few months ago it was made legal.
Well for one you're asking this community, of course all the replies you get are going to be biased as oppose to asking other people. But ill bit, I honestly doubt sony will win this case. They have had several ridiculous lawsuits in the past, and lost the majority of them. Seeing as how the itouch jailbreak was in our favor, Id say this is going to be in our favor.
