There was a credit card on the account and he bought a Live subscription and ms points!! The credit card expires in a few months if that makes any difference. I don't know what to do. I can't return it cause I don't know how to contact the guy but don't know if I should use it!! Can I get banned or sued or anything like that? I haven't signed in with the account except for on my phone. What should I do? Should I remove the credit card from the account by calling Microsoft? Pls help

Seriously I would remove the account. When your friend steals a car and gives it to you, you will also be found guilty. Just delete it.

How do you know if Xbox is investigating your account? Because I can still log in and everything fine.

Someone can ring microsoft and say there account got stolen and if they know the details they will most likely ban the last person signed in on it

Sell it lol. If not get rid of it cause if it gets reported stolen to xbox support then Microsoft will disable xbox live on it and return it to the rightful owner. That how some people scam others for free shit.
