It's a complicated matter. For starters I don't agree with courts handing out the death penalty like candy just because prisons are packed. That's clouding judgement for the worse and making matters complicated.
Anyways, like Clutch Hunter said, when dealing with the death penalty, you could be taking an innocent man's life (like Lincoln Burrows

). On the other hand, I'm not against the moral aspect.
On another note, I find the ruling of it to be weird. Why does 1st degree only warrant the death penalty? Either way, the person is dead right? Who cares about their methods, their victim is ultimately dead and I think that's where punishments should be drawn from.
Now I'm not saying let's give everyone the death penalty that has committed murder, because serving years of their life behind bars could psychologically be worse than death for some. Rather than giving the death penalty based on methods, I think it should be done through quantities. Why do some serial killers get away with tons of murders only to get a 60 year sentence when a guy goes out there and kills one person but since they killed them with a 500 needles they get the electric chair.
I really don't know how to express my complete feelings on this matter through a message, but I just tried.
