this happens when u join someones party and then start in the background you still join him so when he got the headset on he can talk to you but you not to him^^

No I don't think so... you see when you do the exploit and you join ur splitscreen match, for some reason you get a 1.0 k/d ratio for no reason before you even play. So I'm guessing you do get a win, but you get a loss as well.
