Actually they find out what you've been doing if you happen to have your PS3 on and a "possible" connection to the internet.
You don't need to use anything on the PS3, or sign into the PSN, a log of your systems usage stats are sent to Sony servers the minute an active internet connection is found; whether you turned the PS3 on and it was plugged into your router or you turned your router on whilst the PS3 was on and plugged in. Either way, the PS3 sends them info.
Mine has been unplugged from the router since before I jb'ed it and I haven't had this email.
