Post: Perhaps this is why PSN is down?

(adsbygoogle = window.adsbygoogle || []).push({}); I'm not sure if any of you have heard but Matthieu of Overfl0w is stating that his exploit is leading to 3.60 Application Keys, rather they are the encrypted keys that allow users to play the games on the disks. This could in turn lead to a 3.60 Custom Firmware release. Perhaps Sony is using the bad-reputation of Anonymous to cover the fact that rather than they being hacked from an 'outside threat', they are in fact doing a employee-only test into a new PSN-core functionality, designed as a countermeasure against Matthieu's exploit.

What we know:
- PSN is currently down (pretty obvious judging by the ShoutBox :carling: )
- Sony states that it is due to an outside threat, however they could just be saying this.
- Matthieu and Overfl0w are currently looking into an exploit that allows 3.60 AKs (Application Keys) and the possibility of 3.60 CFW.
- We already know Sony do not like us running CFW, as we found out in the days of 3.55.

What could this mean:
- They might be developing a "core-functionality" include that detects the a modified firmware file and instantaneously and permanently bans the console from online services.

By core-functionality, I mean something that would inevitably end up on all of our consoles, perhaps a silent update. We know that Sony are very defensive and get all dinosaur about CFW.

What are the signs
-- When PSN comes back online, check for slow internet at the time you sign in and monitor the speed during the first 5-15 minutes after signing in, if the speed is lower than normal could mean your PS3 is silently updating to counter-act the exploit.
-- Check the Wireless Activity monitor, if its blinking and you aren't doing anything online but are signed into PSN, could mean you are being updated.
-- You will probably have to sign a new User Agreement which may have a clause in there that allows them to silently update your console.

This is all a speculation of course. What do you guys think Smile?

That is where the Terms of Use step in, you have to agree to these terms before you can use the system, and therefore the Terms of Use basically allow them to make modifications to YOUR system with software updates. Hence why you have to agree to the terms
----------------------------------------------------------------------------------------------
THAT is BS, you can use the system perfectly without agreeing to ANYTHING!!!

I Just bought a new system last week on 3.55 slim 320GB

AND I dind't have to agree to anything!

1st It's my system, i'll JB it if I want to (i could AGREE with GEOHOT or any others TOS, as long as it's not SONY's
'LOL'Winky Winky
2nd I'll be RUNNING open Source FIRMWARE

SO F*CK WHATEVER YOU THINK THEY HAVE TO SAY ABOUT IT

THEY CAN'T DO SH*T

THE HARDWARE is MINE!!!
THE FIRMWARE IS OPEN SOURCE!!!

I'm not getting on PSN or whatever with that system, so I don't need to agree/accept crap!

They already do, it says in the ToU :

In Legal Bullshit Speak
Any modifications to the system (PlayStation 3) at either software level (modifications to the firmware) or Hardware Level (modifications to the actual internal circuitry, will forfeit your right to be on PlayStation Network.

In plain english:
Mod your console with either CFW or something like a JTAG means you are saying to Sony 'I dont want the right to be on PSN, please Ban me'

No need to get your pants in a bunch. The Terms of Use state that if you make modifications to your system other than what is supplied by Sony, you vacate the right to go on the PlayStation Network, if you aren't going on PSN anyway, that's your prerogative.

Oh no no no, that is completely allowed, some are even officially licensed by Sony. As I said, it has to be a modification on the software level (Their Firmware) or the Hardware Level (INTERNAL circuitry) to be classed as a breach of ToU.

Spray-painting or doing anything to the visuals of the PS3 do nothing to either of the 2 levels of core-functionality.

So putting rainbows and L.E.D lights on the PS3 in a non-homosexual way is OK?

If you need to wire things inside then it might be a breach, I am not sure.

So your reply was actually useless...

I was talking about them updating my system silently...

Something THEY CAN't DO, cause I didn't agree to anything!

It's not their software anymore, and it's definitely not their hardware anymore!

As a matter of fact, even if you don't sign into PSN, you've already agreed to their Terms of Use, it says in the manual that it comes with
'Usage of the PlayStation 3 system is subject to the Terms of Use found on : URL HERE'

So no, my reply is not useless. I've studied law, and you think their multi-million dollar lawyers and legal-document drafters don't think about the people who dont sign into PSN. Not everyone has internet. As soon as you turn your PS3 on, you've agreed to their Terms of Use, as stated in the manual.
