Doesn't iPad 2's have a one year warranty? I don't know if it still does if it's jailbroken.

Isn't jailbreaking legal in the US? So they shouldn't update it, since it's completely legal, at least that's what I think.

Restore it first because if you send it to them they´ll say that it´s Jailbroken and they won´t accept it

If you send them a jailbroken iPad they won't fix it. It voids your warrenty, and in Apple's eyes jailbreaking is still illegal. There was only one random bill that put jailbreaking in the "grey area" and therefore people assumed it was legal. It's not legal or illegal. But apple won't help you at all unless you restore it and loose the jailbreak.
