As the judge is likely to have no clue what anyone is talking about in this case, he is going to look back to previous, similar cases for a legal precedent, and the most recent, and similar is going to be the case that Apple LOST over the jailbreaking of iPhones.

If courts can tell Apple that there is no way they can use "Possiblity for piracy" as a defence against jailbreaking the iPhone, and that in fact jailbreaking an iPhone is now perfectly legal, then there is no possible way that they can say that Sony, who are using the same reason to sue Geohot, are in the right.

Says the same thing in the ToS for an iPhone. End of the day, if Sony wins this case there will be a shitstorm from Apple..

I think if sony wins we're going to start to realize what we own isn't really ours anymore. We're just buying the usage of a duplicated source

FINALLY SOMEONE POINTS THAT OUT! Lol im sure most of the kids on this forum dont know what a precedent is though.

does it really say that in the T&C? i doubt it would. if so i would like to see it please.

I doubt this will happen , the judge may not understand certain aspects of what they are talking about but most will be explained to him/her I wouldn't base this on previous cases as it's different, different judge, prosecutions etc we will just have to wait and see what happens

Sony are not going to ban anyone.. Geez. Ffs, do you honestly think they're going to be arsed going round each and every single console in the entire world?

There's millions maybe multi millions of consoles out there. Even if they did ban everyone who jb their console, they're gonna get a lot of hate mail.

Never the less they will lose out on money and xbox will snatch the console crown.

Sorry might be a dumb question, but take the xbox for example isn't the JTAG illegal? So wouldn't it be illegal to do this to the ps3? It's not exactly a jtag cause i think you mess with the hardware, but i've never jtag or jailbroken my ps3 or 360
