As the judge is likely to have no clue what anyone is talking about in this case, he is going to look back to previous, similar cases for a legal precedent, and the most recent, and similar is going to be the case that Apple LOST over the jailbreaking of iPhones.

If courts can tell Apple that there is no way they can use "Possiblity for piracy" as a defence against jailbreaking the iPhone, and that in fact jailbreaking an iPhone is now perfectly legal, then there is no possible way that they can say that Sony, who are using the same reason to sue Geohot, are in the right.

You'll still get banned off of online games more than likely because you can do anything you like with "YOUR" system but when it interfers with other's gameplay and other stuff pertaining to that you passed the warning zone.
