I am going to email them as well, this was we will have a written document and a voice recording of sony help employees telling us we can not get banned for CFW back ups IF they are your games.

Recently I have heard rumors about a custom firmware by the same guy who first hacked the iPhone. Some people are telling me using this will get me banned whatever I do and others are telling me it is safe. I am really only slightly interested in this because I have heard you can back up your games you have bought to your ps3's hard drive so if I ever got the disc scratched or lost it I would still have it, some people are telling me if I did do this I would be banned from PSN. But if they were my own games I bought legally would I be banned? It would be no different to me using a disc its just I have a fair bit of memory I don't think I will use on my ps3 and may as well utilize it some way.

You have to play the games from a disk or they will ban you as theres no way they could know you bought the game. From what i understand, So long as your not using piracy homebrew is OK
