There is nothing illegal about CFW only thing Sony could do is prevent you from accessing their systems mean the PSN store and update servers and online game play servers, DMCA protects your rights to OWN equipment and not pay a leasing fee. It allows you to add functionality to systems like the XBOX and the PS3. MODChips are however illegal if the promote PIRACY. But to blanket everyone that uses CFW under the title of a PIRATE is a large stretch.

thre is other systems and servers coming online that allow youto link and play Lan games and the alike.

guys Sony gonna do a massive ban, banning just the current user that been reported or they know have it and banning them right away would be pointless since they will have to repeat it over and over again. I am sure Sony is gonna do ban waves like MS does sometimes.

I highly Doubt it, Sony is trying to keep a market share, and Bans cause Grief, and people stop buying their products and move to something else. I can see KEY players getting banned, from PSN/ONLINE but Sony will not MASS ban users.
They have had a long run of not being Hacked, and it is really their own fault for removing OtherOs ability that has landed them in this situation, as it was illegal on their part to remove it. Then they lied to consumers saying the SLIM PS3 would not support it, No they just made it so the SLIM could not run it.

Actually no, cfw is based on existing code and falls under the same law as modifying anyone's code; it has to be a certain percentage your own work to be considered as not belonging to the original's creator.
Last time a case about software ownership after changes came around it was quite a high percent that had to be new/altered.
So Sony can lawfully stop your software from running (via whatever means) and stop access to the PSN (which had separate terms upon connecting to).
The hardware's yours though.
I'm pretty sure if they do block the fw from working someone else will make it work, thus the battle continues.

Im not sure if this has been mentioned or not, but if they do start to ban users Im sure someone will eventually find a way to get them/us unbanned.
For example. There are crap loads of players on XBL who use JTAG and they're playing online when they are supposed to be banned.
Same could be said for PSN. We'll evenfually find a way around it if massive bans do happen.

one thing to remember you have to agree to all of the EULA to use their system so if one part is found to be unconstitutional or violate the law then the entire contract is void.
So that Ban your account from PSN they decrease the functionality that allows you to play online with your friends, could be grounds enough for a class action lawsuit.
